The 10-Year DUI Look Back Period

In most states, receiving two or more DUIs within a certain period of time can result in harsher punishments. In Georgia, the "look back period" is 10 years—if you receive two or more DUIs within this length of time, you may be subject to additional punishments upon conviction. This includes increased fines, extended jail time, longer license suspension, and other penalties.

Second DUI Offense

If you are facing a second DUI conviction within 10 years of an earlier conviction, then the punishments you may receive are significantly harsher than the first DUI conviction. Minimum fines and minimum jail time are increased, as is the license suspension period. Although the penalties for this conviction may be more severe, a second DUI conviction still counts as a misdemeanor. Additional DUI convictions within 10 years may be considered more serious criminal offenses.

The punishments for a second DUI conviction include:

  • Jail sentence of 3 days to 1 year
  • Fines from $600 to $1,000
  • License suspension of 3 years
  • Community service for minimum of 240 hours

Third DUI Offense

A third DUI conviction within 10 years of two other DUI convictions is taken very seriously. Considered a "high and aggravated" misdemeanor, the punishments for this conviction are much more severe than a first or second DUI charge. There are two major differences in punishment: you may face a jail sentence of one to five years, and your license may be suspended indefinitely.
